Charter Disclosures

These disclosures describe the basis on which AIR NAPA arranges charter services.

Broker status

AIR NAPA is an air charter broker. AIR NAPA is not a direct air carrier or a direct foreign air carrier and is not in operational control of any aircraft. All air service advertised by AIR NAPA will be provided by a properly licensed direct air carrier or direct foreign air carrier, which will be in operational control of the aircraft at all times.

A request is not a booking

Request a flight, not a booking. Submitting this form is a request for options only. No flight, aircraft, operator, or time is confirmed, and no contract exists, until AIR NAPA has disclosed the operating carrier and the other information required before contract and you have accepted a written charter agreement supported by a binding commitment from that carrier.

What you are told before contract

Before entering a contract for a specific flight, AIR NAPA discloses: (1) the corporate name of the direct air carrier in operational control and any other names in which that carrier holds itself out to the public; (2) the capacity in which AIR NAPA is acting for that contract, as indirect air carrier, agent of you the charterer, or agent of the operating carrier; and (3) whether AIR NAPA holds liability insurance covering the charterer, passengers and property on the flight, and the monetary limits of any such insurance. On your request before contract, AIR NAPA also discloses: (4) any corporate or business relationship between AIR NAPA and the operating carrier that may have a bearing on selection, where AIR NAPA acts as your agent; (5) the total cost of the air transportation paid by or through AIR NAPA, including broker and carrier fees and government taxes and fees; and (6) any fees you must pay directly to third parties, the amount if known or a good-faith estimate if not. If information is not yet known or changes, it is provided within a reasonable time after it becomes available and before the start of your transportation, with the cancellation and refund protections described below, as provided in 14 CFR 295.24.

Example aircraft

Aircraft types, cabin images, capacities, and ranges shown on this site are examples for education only. They do not represent aircraft owned by AIR NAPA, aircraft guaranteed to be available, or the specific aircraft that will operate any flight. The operating carrier and, where confirmed, the specific aircraft for your flight will be disclosed before contract.

Cancellation and refunds

Cancellation terms for your specific flight, including any carrier-imposed cancellation fees and deadlines, are stated in your charter agreement and prevail for voluntary cancellations by you. Separately, and in addition to those terms: if AIR NAPA fails to provide required disclosure information (or notice of a change to it) within a reasonable time after it becomes available, you will be offered the opportunity to cancel as provided in 14 CFR 295.24(c) or, for changes after transportation has begun, to cancel the remaining portion under 295.24(f), with a full refund for transportation and services not yet provided. If your charter air transportation cannot be performed, or a refund is otherwise due, AIR NAPA will make prompt refunds as required by 14 CFR 295.26 (including within 20 days after a complete refund request for cash or check purchases; credit-card refunds as required by 14 CFR 374.3 and 12 CFR Part 226).

Empty legs

Empty-leg opportunities are contingent. An empty leg exists only because another customer's confirmed flight requires the aircraft to reposition. If that underlying flight changes or cancels, the empty leg may change time, change routing, or be cancelled, even after your request. No empty leg is confirmed until the operating carrier is disclosed to you, you have accepted a written agreement, and the carrier has given a binding commitment for that leg. Prices, if shown, are the carrier-confirmed price for that specific leg at the time stated on the listing, not a discount from an invented regular price, and listings are removed when they expire or are withdrawn. If a confirmed empty-leg flight cannot be performed, refunds will be made as required by 14 CFR 295.26 and your agreement.

Helicopters

Helicopter transfers and scenic flights are operated only by the disclosed, properly authorised operator, and every route is subject to operator authorisation, aircraft capability, landing permission, airspace restrictions, weather, and safety requirements. AIR NAPA does not promise landings at any vineyard, estate, hotel, or private property unless the operator has confirmed that specific landing is authorised in writing for your flight. Scenic flights, where offered, will be operated by the operator under the authority applicable to that flight, which the operator will confirm before contract.

Third-party services

Ground transportation, accommodation, dining, and other concierge arrangements, where offered, are provided by independent third parties, not by AIR NAPA or by the operating air carrier, unless your agreement states otherwise in writing. AIR NAPA does not claim access to any private estate, winery, or venue without that venue's authorisation.
