Broker, Operator and Direct Air Carrier: Who Does What

Please note: AIR NAPA is an air charter broker. AIR NAPA is not a direct air carrier or a direct foreign air carrier and is not in operational control of any aircraft. All air service advertised by AIR NAPA will be provided by a properly licensed direct air carrier or direct foreign air carrier, which will be in operational control of the aircraft at all times.

The direct air carrier operates the flight: it holds the FAA certificate and DOT economic authority, its aircraft are listed on its Operations Specifications, and it has operational control at all times. An air charter broker holds out, sells or arranges single-entity charter using a direct carrier. Under 14 CFR Part 295 a broker acts in a disclosed capacity: as an indirect air carrier, as a bona fide agent of the charterer, or as a bona fide agent of the direct carrier.

The capacity matters because it decides who you contract with and who owes you refunds. It must be disclosed for your specific contract, not buried in general terms. AIR NAPA is a broker and concierge. It is never the operator of your flight.

Aircraft types, cabin images, capacities, and ranges shown on this site are examples for education only. They do not represent aircraft owned by AIR NAPA, aircraft guaranteed to be available, or the specific aircraft that will operate any flight. The operating carrier and, where confirmed, the specific aircraft for your flight will be disclosed before contract.
